Christine Brown’s Custody Battle with Kody Takes a Turn As the Court Issues a Warning!
Christine Brown’s legal battle with ex-husband Kody Brown has escalated, with the two former spouses now embroiled in a significant custody dispute.
On December 18, the exes participated in a court hearing — conducted via web conference due to Kody residing in Arizona and Christine in Utah — as part of Christine’s ongoing lawsuit against Kody. The case, filed in September, seeks to establish paternity, custody, and child support for their youngest child, 13-year-old Truly.
Court documents obtained by The Ashley reveal that both parties have completed their case disclosures and are scheduled to attend a mediation conference on May 21, 2025.
Court Designates High-Conflict Track to Case
While the progression of custody cases often follows predictable steps, Christine and Kody’s case took an unexpected turn this week when the court classified it as both Track 1 and Track 3. Under Utah’s domestic court system, Track 1 is standard, but Track 3 is reserved for cases involving significant custody disputes. According to the Utah State Courts website, Track 3 assignments typically involve high-conflict cases, including those with allegations of child abuse or domestic violence.
“For a Track 3 case, at the case management conference the court and parties will address whether a custody evaluation is necessary and whether a private guardian ad litem should be appointed,” states the court’s website.
While The Ashley notes that there is no confirmation of allegations of abuse or violence in this case, the Track 3 designation highlights the complexity and conflict involved in the custody battle.
Christine Requests Paternity Test for Truly
Christine’s legal filing — a “Petition for Declaration of Paternity, Child Custody, Parent Time, and Support” — requests that Kody take a paternity test to confirm his biological relationship to Truly. As fans of Sister Wives may recall, Christine was Kody’s third wife in their polygamous family. Their marriage was not legally recognized, and Kody’s name does not appear on the birth certificates of the six children he shares with Christine.
According to court records, a fee was paid for a paternity-related process on October 23, the same day Kody filed his response to Christine’s lawsuit. This indicates that the paternity test has either been completed or is currently underway.
Court Protects Personal Details from Public View
Furthermore, Wednesday’s court hearing was not recorded, photographed, or transmitted, per the court’s ruling. Any attempt to do so would have resulted in charges of contempt of court, punishable by fines or jail time.
Custody Dispute Likely to Feature on ‘Sister Wives’
Although this week’s hearing will not be part of the show, it’s likely that Christine and Kody’s ongoing legal battle will feature in future episodes of Sister Wives. The case highlights the emotional and logistical challenges of navigating co-parenting and custody arrangements after the dissolution of a long-term polygamous relationship.
As the mediation date approaches, Christine and Kody must prepare for the possibility of further legal proceedings, including custody evaluations or the appointment of a guardian ad litem. For now, the former couple’s focus remains on reaching an agreement that prioritizes Truly’s best interests.
