Attorneys representing Elon Musk are preparing to file a motion to dismiss a case that accuses him of using AI-generated, copyright-infringing “Blade Runner” inspired images at a Tesla press event. Musk, who is also the chief of President Donald Trump’s DOGE organization, and Tesla are named as defendants in the suit. The motion, which will seek to dismiss all claims with prejudice, was submitted to the U.S. District Court Central District of California, Western Division.
Alcon Entertainment, the plaintiff in the lawsuit, plans to oppose the motion according to the court filing. Last October, Alcon, the production company behind “Blade Runner 2049,” filed a lawsuit against Musk, Tesla, and Warner Bros. Discovery (WBD) for allegedly violating its intellectual property rights.
The lawsuit claims that Musk and WBD requested to use imagery from “Blade Runner 2049” to promote Tesla’s futuristic concept cars without permission. When Alcon refused to grant rights through WBD, Tesla, under Musk’s direction, allegedly used an AI model to replicate the imagery. The lawsuit also alleges that Musk displayed the replicated “Blade Runner” imagery at the event without Alcon’s knowledge.
Alcon seeks to prevent Tesla from further distributing the disputed promotional materials and is pursuing unspecified damages. The lawsuit points out that violations under the U.S. Copyright Act can result in penalties of up to $150,000 per violation. Alcon estimates that Tesla would have needed to spend at least $500,000 and possibly up to $10 million to obtain proper rights to use the “Blade Runner 2049” brand affiliation for its cybercab concept.
